Citizens of Lakewood, Colorado, learned of a plan to poison the prairie dog inhabitants of that city's greenbelt open space. They contacted RMAD for help. RMAD's chief legal counsel, Jennifer Melton, filed suit in late October 1998 requesting a preliminary injunction preventing the poisoning.

Melton made the case that this action violated Colorado's prohibition against poisoning wildlife. Even though prairie dogs can legally be poisoned, the wildlife who live with them generally cannot. In November 1998, Judge Leland Anderson of the Jefferson County District Court granted the injunction. The City of Lakewood subsequently appealed this decision.
